A ello se suma el hecho de que las herencias intestadas suelen ser m\u00e1s complicadas, requieren m\u00e1s tiempo y costes generalmente.<\/p>\n<p>Otra pregunta frecuente se refiere a la posibilidad de incluir los activos espa\u00f1oles en un testamento firmado en otro pa\u00eds. \u00bfEs esto una opci\u00f3n? La respuesta es afirmativa, pero, teniendo en cuenta que las diferencias existentes entre los sistemas jur\u00eddicos, a menudo ello conduce a un proceso complejo de adjudicaci\u00f3n y aceptaci\u00f3n de la herencia; y debemos insistir en que esta no es la mejor opci\u00f3n generalmente, remarcando que simplemente los costos de traducci\u00f3n de un testamento extranjero al espa\u00f1ol, siempre necesario, ser\u00edan m\u00e1s altos que firmar un testamento ante notario espa\u00f1ol.<\/p>\n<p>Una buena opci\u00f3n es la de firmar dos testamentos distintos, uno relativo a los bienes en su pa\u00eds de origen, y otro en relaci\u00f3n con los bienes situados en territorio espa\u00f1ol; posibilidad que no debe ser ignorada en absoluto y que es muy pragm\u00e1tica. El asesoramiento en este tipo de documento es frecuente, requiere una redacci\u00f3n meticulosa y cautelosa, ya que podr\u00eda invalidarse involuntariamente uno de los testamentos con la firma del otro con una redacci\u00f3n incorrecta, ya que t\u00e9cnicamente en Espa\u00f1a el \u00faltimo testamento anula la eficacia del anterior sino se incluye una cl\u00e1usula que salvaguarde su eficacia en lo relevante.<\/p>\n<p>Cuando se firma testamento en Espa\u00f1a se puede designar la aplicabilidad de las leyes de su pa\u00eds de origen al proceso sucesorio que afecte a sus bienes en este pa\u00eds. Es imprescindible estipular a qu\u00e9 sistema normativo se quiere someter la sucesi\u00f3n. No haber firmado testamento en ning\u00fan pa\u00eds se convierte en un factor desfavorable en determinadas circunstancias, ya que la aplicaci\u00f3n de la normativa relativa a sucesiones intestadas a aplicar podr\u00eda no coincidir con el destino que pretend\u00eda o esperaba para su patrimonio.<\/p>\n<p>Nuestro consejo es siempre firmar, si es posible, un testamento espa\u00f1ol relativo a sus bienes en Espa\u00f1a ya que el coste legal no es elevado, y se evitar\u00e1 ralentizar todo el proceso y los consiguientes retrasos en el cumplimiento de los plazos legales para el pago de impuestos, en caso de que su pago corresponda.<\/p>\n<p>El formato del testamento espa\u00f1ol difiere generalmente del utilizado en otros pa\u00edses; en Espa\u00f1a ser\u00e1 redactado en dos idiomas si el espa\u00f1ol no es su primera lengua, el que el firmante comprenda perfectamente, y adem\u00e1s en espa\u00f1ol; y lo que es m\u00e1s importante, debe ser verificado y autorizado por un Notario P\u00fablico.\u00a0 El papel de esta figura jur\u00eddica es de suma importancia en Espa\u00f1a. La forma m\u00e1s sencilla de otorgar un testamento espa\u00f1ol es hacerlo directamente in situ, en Espa\u00f1a. Tambi\u00e9n se puede redactar en el extranjero utilizando los servicios de un Notario P\u00fablico extranjero, pero esto complica en gran medida el proceso de registro del testamento ante el Registro Central de \u00faltimas voluntades y la custodia del original en cuesti\u00f3n.<\/p>\n<p>Podemos ofrecerle toda la asistencia necesaria en el proceso de planificaci\u00f3n de su proceso sucesorio espa\u00f1ol, y la redacci\u00f3n en ambos idiomas de un testamento de acuerdo con sus deseos y considerando la normativa pertinente.
