Les pays qui adh\u00e8rent \u00e0 la Convention reconnaissent mutuellement la validit\u00e9 juridique de l\u2019Apostille.<br \/>\nCe Trait\u00e9 international est une organisation permanente cr\u00e9\u00e9e le 5 octobre 1961 dans le but de simplifier les proc\u00e9dures administratives internationales entre ses membres. Plus de 180 pays et juridictions ind\u00e9pendantes font partie du pr\u00e9sent trait\u00e9. Il facilite la circulation des documents publics \u00e9labor\u00e9s dans n\u2019importe quel pays membre \u00e0 \u00eatre reproduit dans un autre pays avec la simple d\u00e9livrance d\u2019une Apostille. Les pays signataires utilisent le m\u00eame mod\u00e8le ou un mod\u00e8le semblable.<br \/>\nLa d\u00e9finition de l\u2019Apostille est \u00a8la validation d\u2019un document d\u00e9livr\u00e9 dans un pays membre pour son utilisation dans un autre pays membre\u00a8. L\u2019Apostille sur un document public \u00a8\u00e9tranger\u00a8 certifie l\u2019authenticit\u00e9 de la signature, la capacit\u00e9 dans laquelle la personne qui signe le document a agi et, le cas \u00e9ch\u00e9ant, l\u2019identit\u00e9 du sceau ou du timbre que le document porte. Les apostilles sont toujours d\u00e9livr\u00e9es dans la langue officielle du pays d\u2019origine. Toutefois, les 10 \u00e9l\u00e9ments d\u2019information inclus sont universels dans toutes les Apostilles, pour s\u2019assurer que n\u2019importe qui peut identifier l\u2019information, quelle que soit la langue.<br \/>\nIl est \u00e9galement important de mentionner le R\u00e8glement sur les Documents Publics 2016\/1191 en vigueur depuis le 16 f\u00e9vrier 2019 dans l\u2019UE, qui vise \u00e0 \u00e9viter la paperasserie et les co\u00fbts pour les citoyens lorsqu\u2019ils doivent pr\u00e9senter dans un pays de l\u2019UE un document public publi\u00e9 dans un autre pays de l\u2019UE, sans exiger qu\u2019une soi-disant Apostille soit jointe au document. Les certificats de naissance, de mariage et de d\u00e9c\u00e8s sont quelques exemples de ces documents ; la parentalit\u00e9, l\u2019adoption, la r\u00e9sidence ou la citoyennet\u00e9, etc. Le r\u00e8glement couvre \u00e9galement les extraits de casier judiciaire d\u00e9livr\u00e9s dans le but d\u2019attester qu\u2019une personne n\u2019a pas de pass\u00e9 d\u00e9lictueux. Les documents obtenus avant la r\u00e9forme doivent \u00e9galement \u00eatre accept\u00e9s dans le cadre du R\u00e8glement. Des formulaires standard multilingues ont \u00e9galement \u00e9t\u00e9 introduits pour l\u2019usage des \u00c9tats Membres, r\u00e9duisant ainsi le besoin de traductions.<\/p>\n<p>Lorsque les documents proviennent d\u2019un pays qui n\u2019a pas ratifi\u00e9 la Convention de La Haye, l\u2019Apostille ne peut pas \u00eatre \u00e9tiquet\u00e9e. Dans de telles circonstances, lorsqu\u2019un document doit \u00eatre utilis\u00e9 dans le cadre d\u2019un processus judiciaire espagnol et doit \u00eatre \u00a8authentifi\u00e9\u00a8, la m\u00e9thode \u00e0 utiliser est le processus de \u00a8L\u00e9galisation\u00a8 en place dans le pays qui a d\u00e9livr\u00e9 le document.
